New Guidelines for Thialand BOI Positions

The Thailand Board of Investment (BOI) has introduced updated regulations under Announcement No. Por. 8/2568,
effective October 1, 2025, governing the employment of foreign personnel in BOI-promoted companies. These guidelines establish criteria for the approval, renewal, and placement of expatriates, ensuring compliance with Thai employment quotas and minimum income requirements. All applications must be submitted electronically through the BOI’s Single Window (SW) system.
The Position Requirements for Foreign Personnel.
The BOI has established specific criteria for employing foreign personnel, tailored to different position levels:
- Executive Level Positions: Chairman, President, Ceo, Cfo, Coo, Cto, Vice Chairman, Vice President, Executive Director, Managing Director, General Manager.
- Requirements: Minimum age of 27 years and a minimum salary of THB 150,000.
- Qualifications: At least 5 years of work experience, Note: Positions such as Chairman, President, CEO, or Managing Director are exempt from age and experience requirements.
- Management Level Positions: Manager Or Advisor, Production Manager, Marketing Advisor, Factory Manager, Assistant Managing Director, Assistant Vice President.
- Requirements: Minimum age of 27 years and a minimum salary of THB 50,000 with a relevant Bachelor’s degree or THB 75,000 without one.
- Qualifications: At least 5 years of work experience
- Entry-Level (Operations) Positions: Including Technicians and Supervisors.
- Requirements: Minimum age of 22 years and a minimum salary of THB 50,000 with a relevant Bachelor’s degree or THB 75,000 without one.
- Qualifications: At least 2 years of work experience or 5 years if experience does not align with education background.
Specialized Roles (e.g., Engineers, Researchers, IT Specialists):
Engineer:
- Requirements: Minimum age of 22 years and a minimum salary of THB 50,000 with a relevant Bachelor’s degree or THB 75,000 without one.
- Qualifications: Must hold a bachelor’s degree or higher in Engineering and have at least 2 years of work experience in a related engineering position; or, if not holding a degree in Engineering, must have at least 10 years of work experience directly related to engineering or in the field where the work will be performed.
Information Technology Specialist
- Requirements: Minimum age of 22 years and a minimum salary of THB 50,000 with a relevant Bachelor’s degree or THB 75,000 without one
- Qualifications: Must hold a bachelor’s degree or higher in Science, Technology, or related fields in Information Technology or Software Development, with at least 2 years of experience relevant to the duties; or, if not holding a degree in these fields, at least 5 years of relevant work experience
TISO Workstation Operator:
For supporting trade and investment activities in International Business Process Outsourcing – IBPO and Business Process Outsourcing – BPO
- Requirements: Minimum age of 22 years and a minimum salary of THB 35,000
- Qualifications: At least 2 years of work experience and have relevant training certificates in related fields.
Teacher:
- Requirements: Minimum age of 22 years
- Qualifications: At least 2 years of experience aligns with the field of work or, if the qualifications do not match the field, must have at least 5 years of relevant work experience and submit the appointment letter for the teacher and the professional license from the Teachers’ Council
Pilot:
- Requirements: Minimum age of 22 years
- Qualifications: At least 2 years of experience aligns with the field of work or, if the qualifications do not match the field, must have at least 5 years of relevant work experience and submit a professional license validation and supporting documents from the Civil Aviation Authority of Thailand.
Employment Quota Requirements for Manufacturing Companies
BOI-promoted manufacturing companies with a total workforce exceeding 100 employees both Thai and foreign nationals combined must maintain at least 70% Thai employees. This requirement takes effect on January 1, 2026, for projects promoted before June 5, 2025, and on October 1, 2025, for projects promoted on or after that date.
The following details outline the key provisions:
- Quota Calculation Methods:
If companies with over 100 employees, the number of foreign personnel is calculated based on manufacturing project promotion certificates in the SW system, using the formulas:- Foreign personnel ≤ (Thai employees × 3) ÷ 7 or
- Thai employees ≥ (Foreign personnel × 7) ÷ 3
Example: A company with 90 Thai employees and 30 foreign personnel (120 total employees) satisfies the 75% Thai employee requirement
- Proof of Thai Employees:
Manufacturing companies must submit Social Security Office (SSO) contribution forms to verify Thai employee numbers- The initial submission requires the latest SSO form for the month prior to enforcement or before the first personnel placement request post-enforcement.
- Manufacturing and service companies with 30 or fewer foreign personnel must submit SSO forms annually for December wages by February of the following year.
- Manufacturing only Companies with more than 30 foreign personnel must submit SSO forms quarterly within the end of the month, every 3 months from the last submitted wage month.
The Criteria for Position Approval and Extension
The Position approvals and extensions are evaluated based on factors such as business type, technology level, operational processes, business expansion plans, capacity expansion, process improvements, product quality standards and the availability of qualified Thai personnel. Maximum approval durations are:

Proof of Income Requirements
- Income Requirements
- Initial Application: An employment contract clearly stating the remuneration amount.
- Extension Approval: Submission of tax documents (PND.1Kor or PND.1 form) covering at least the past three months for employment periods of less than one year.
The companies are advised to review their staffing structures, ensure alignment with these regulations, and maintain accurate Social Security records to facilitate smooth application and renewal processes.
